This is a translation for your convenience. In the event of any discrepancy, the German version of these terms and conditions (AGB) is authoritative.
1 General provisions
- Openair Frauenfeld is a festival organised by First Event AG, referred to below as the “organiser”.
- By purchasing a ticket to the festival, the purchaser accepts these terms and conditions. A ticket holder who did not acquire their ticket through the ticket agents designated by the organiser, or who otherwise came into possession of a ticket, accepts these terms and conditions at the moment they take possession of the ticket.
- The festival takes place outdoors in all weather.
- The instructions of the organiser's staff must be followed strictly. Failure to comply will result in removal from the festival area without refund of the ticket price. The organiser reserves the right to take civil and criminal action.
- The festival area consists of the following fenced-off sub-areas: festival grounds, VIP zone, campsites and the festival car park. Access to the festival area or to individual sub-areas is only permitted with a valid ticket, during the access times published for the relevant category on the organiser's website.
- Festival visitors agree that, as part of the audience, they may be captured in photographs, audio and video recordings before, during and after the festival. These recordings may be used and exploited commercially by the organiser and/or third parties without compensation. Visitors expressly and irrevocably waive any assertion of their personality rights in this respect.
- Festival visitors must be at least 16 years old. Under the age of 16, admission is only permitted when accompanied by a legal guardian or with the written consent of a legal guardian. The organiser accepts no responsibility and/or liability in the event of non-compliance.
2 Programme
- The organiser has no influence whatsoever over the form and content of the artists' performances. The organiser accepts no liability in this respect.
- The organiser reserves the right to change the content and/or the programme of the festival at any time and without prior notice.
3 Noise
- At concerts, the volume may pose a risk of damage to hearing and health. Earplugs are handed out at the entrances to the festival area and at special locations within it.
- The organiser accepts no responsibility for any damage to hearing or health.
4 Security
- The organiser's security service carries out security and admission checks at all official entrances to and along the festival area, and throughout the duration of the festival.
- In consultation and cooperation with the local police authorities, the security service carries out random bag checks and body searches.
- The organiser reserves the right to refuse a festival visitor access to the festival area, or to remove them from it, for good cause. Where the festival visitor is not at fault, the organiser may refund the ticket price at its own discretion. Failure to comply with these terms and conditions constitutes good cause.
5 Access to and conduct within the festival area
5.1 Traffic
- Parking on the access roads to the festival area and within the festival area (excluding the festival car parks) is strictly prohibited.
- Vehicles parked on the access roads or outside the festival car park will be towed away without prior notice at the owner's expense. The vehicle owner becomes liable for costs and must bear all expenses as soon as the towing service has been called.
- Vehicles are parked at the owner's own risk.
- Public transport should be used wherever possible.
5.2 Admission
- The ticket must be exchanged for a control wristband at the organiser's official box offices and exchange points. The control wristband is personal and non-transferable.
- Everyone entering the festival area (excluding the festival car park) must wear the control wristband firmly closed around their wrist before entering.
- Damaged control wristbands, and wristbands not worn firmly around the wrist, do not entitle the holder to any of the organiser's services, in particular not to admission, and are invalid.
- Depending on the wristband, the control wristband entitles the holder to enter the festival grounds, the campsites and the VIP zone for the period stated on the ticket.
- Lost tickets, complimentary tickets or control wristbands are generally not replaced.
- Persons found within the festival area (excluding the festival car park) without a properly fastened wristband will be removed and reported.
- The organiser reserves the right to change admission times without prior notice. The organiser accepts no liability for delays at admission.
5.3 Recordings
- Photographic, audio, film and video recordings of the artists performing at the festival are not permitted. Recordings for private use are generally allowed.
- The commercial use and exploitation of photographic, audio, film and video recordings of the artists performing at the festival, of festival visitors or of the festival infrastructure is prohibited.
- Infringements will be prosecuted under civil and criminal law.
5.4 Further rules
- Prohibited items and animals within the festival area are:
- Parasols and umbrellas as well as (flag) poles
- All firearms, spray weapons, stabbing, striking and cutting weapons as well as other items classified as dangerous, including pocket knives
- Digital or analogue SLR cameras with or without interchangeable lenses, film and video cameras and audio recording devices
- Selfie sticks, GoPro sticks and similar
- Drones and other airborne devices, with or without cameras
- Rollerblades, skateboards and kick scooters, roller skates, bicycles, prams and similar
- Glass
- Pyrotechnic items, firecrackers, dry ice
- Straw (bales) and similar products
- Household items, sofas and similar
- Animals
- Each person may bring 3 litres of drinks onto the campsites once, in units of their choice; this is not permitted in any other sub-area.
- A simple deposit system applies to tents of any kind. Whether gazebo, igloo tent, army tent or another variant — a deposit of CHF 20.00 is payable for every tent. The CHF 20.00 is refunded at the end of the festival at the exit on presentation of the tent (including the token).
- A deposit of CHF 2.00 is charged on every drink purchased within the festival area. The deposit is refunded at all bars and drink stands. Organised collection of deposits by individuals or organisations — even under the guise of a “good cause” — is prohibited without prior agreement with the organiser. Anyone infringing this will be removed from the festival area without refund of the ticket price.
- Staying on the fenced-off campsite is only permitted with a festival ticket, during the opening times communicated by the organiser.
- Staying on the fenced-off campsite is permitted exclusively to persons holding both a valid festival ticket and a valid camping voucher. Access and stay are only possible during the opening times communicated by the organiser.
- No fires may be lit within the festival area without the organiser's permission.
6 Tickets
- Tickets may only be purchased through the ticket agents designated by the organiser.
6.1 No right of return or refund
- Under no circumstances is there a right to return a ticket or a claim to a refund of the ticket price.
- Festival visitors acknowledge in particular that the festival line-up may change at any time, including at short notice; whether performance times shift or an artist does not perform at all. These and similar circumstances give rise to neither a right to return the ticket nor a claim to a refund of the ticket price.
6.2 Resale of tickets
- Acquiring tickets for the purpose of resale is prohibited. The organiser carries out corresponding checks and may block tickets acquired for the purpose of resale and declare them invalid. Civil and criminal action is reserved.
7 Liability
- To the extent permitted by law, any liability of the organiser for its own conduct and for the conduct of its auxiliary personnel is excluded. In particular, the organiser and its auxiliary personnel are not liable for personal injury or financial loss caused to festival visitors by third parties (e.g. stand operators).
- The organiser is not responsible for lost or stolen items. Items found are handed over to the Frauenfeld lost property office after the festival.
8 Final provisions
- If the festival has to be cancelled or postponed due to force majeure (e.g. war, death or illness of an artist, severe weather, disasters, civil unrest, threat, warning or act of terrorism, epidemics, pandemics, official prohibition or refusal of authorisation for the festival through no fault of the organiser, etc.), there is neither a right to return the ticket nor a claim to a refund of the ticket price; the ticket can only be exchanged for a ticket to the next edition of the festival. In exceptional cases the organiser may decide at its own discretion, on a case-by-case basis, whether to refund the ticket price instead, less a handling fee of 10 % of the purchase price (maximum handling fee CHF 50.00). There is no entitlement to this.
- If the festival has to be interrupted or abandoned due to force majeure, there is no right to return the ticket, no claim to a refund of the ticket price and no claim to an exchange for the next edition of the festival. An interruption means any temporary interruption of the festival occurring after the festival has opened (e.g. due to severe weather). Abandonment means any termination of the festival occurring after the festival has opened (e.g. due to an official prohibition).
- Amendments to these terms and conditions must be made in writing.
- There are no side agreements.
- The organiser reserves the right to amend these terms and conditions at any time. Amendments are deemed accepted unless objected to within 30 days of publication.
- These terms and conditions are governed exclusively by Swiss law, excluding its conflict-of-law rules and the Vienna Sales Convention. Frauenfeld, Switzerland, is agreed as the exclusive place of jurisdiction for all disputes.
